Booking procedure, payment terms and remittance
1.1
Guests should complete the enquiry form to check availability.
1.2 If
guests choose to proceed with a formal booking, they must complete
this booking form.
1.3 We
prefer that all bookings be made using American currency. However, as
a courtesy to our guests booking from the UK, the completed booking
form may be signed and returned with a non-refundable
advance lodging deposit of
£150. Our management company will also
gladly accept your booking deposit via credit card with the standard
4% surcharge. Cheque/Check should be
mailed within 5 days, and made payable to:

Alternatively, booking deposits may be made using a credit card or
Paypal via our management in Florida (Iain Robinson
USA 407 334 3804) for the
standard 4% surcharge. In the event of
a cheque/check not being honored by the bank on which it is drawn we
will make a charge of £17 /$30 to cover
the bank charges and our administration costs.
1.4 For
guests booking from the USA or overseas, the completed booking form
must be signed and returned with a non-returnable
advance lodging deposit of
$350. Our management company will also
gladly accept your booking deposit via credit card with the standard
4% surcharge. Check should be mailed
within 5 days, and made payable to:

1.5 A
booking will only be considered firm, when the deposit has been
received and when we have confirmed the booking in writing to the
guest.
1.6
Provisional bookings will be held for the guest for five (5) working
days.
1.7
The balance is due eight (8) weeks before the
date you arrive at the villa.
1.8 Bookings made within eight (8) weeks of departure are payable in
full at the time of booking.
1.9 A
£150/$300
deposit is required as a
refundable security deposit (against loss or damage to the villa).

Your card
will not be charged, unless an unsatisfactory management report has
been received from the cleaners, upon your departure, that indicates
that there has been some loss or damage to the villa.
1.10
You may change your booking, in which case we will make every effort
to accommodate any requests. There is a
£25/$39 fee per week for this service.
1.11
Minimum booking period is one week (7 days), unless special
arrangements have been made at the time of booking.

Cancellations
2.1 You
may cancel the booking at any time after it has been confirmed, subject
to clause 2.3 below.
2.2 If
the Guest wishes to cancel the booking he should advise the Owner
immediately by telephone followed by confirmatory letter.
2.3
The Owner shall be entitled to retain all
payments already made (except the Security Deposit) and to recover, if
not already paid, the balance of the rental amount in accordance with
clauses 1.7 and 1.8 above: • any cancellation, loss of full booking
deposit • cancel within 12 weeks of arrival, 50% of total rental •
cancel within 8 weeks of arrival, 100% of total rental.
2.4 If
Guest cancels in violation of this clause, Owners will use their best
effort to try and secure another booking for the subject timeframe. If
another booking is secured, cancellation charges to the original guest
will be limited to the difference in rent necessary to secure the new
“last minute booking”, plus an admin fee in accordance with 2.7 below.
2.5 In
the unlikely event that circumstances beyond the Owner’s control
necessitate the cancellation of the rental arrangement, the Owner
reserves the right to cancel any bookings at any time and will only be
liable to refund monies already paid by the Guest.
2.6 The
security deposit is not subject to cancellation charges and would be
refunded in full.
2.7 All
cancellations are subject to a £25/$39
administrative fee.

Alterations by the Guest
3.1 If
once the booking has been accepted, the guest wishes to make any
alterations to the booking detail, we will do all we can to assist you
provided that the request is made in writing (e-mail is acceptable) by
the person who has signed the booking form.
3.2 Some
alterations may incur an administrative fee of
£25/$39.
3.3
Material alterations may be treated as a cancellation.
3.4 Any
alterations made less than nine (9) weeks before the date of arrival,
may be treated by us as a cancellation and so subject to the
cancellation charges, outlined in 2.3 above.

Cancellations by us
4.1 In
the unlikely event of cancellations by us, we will inform you as soon as
reasonably practicable and fully refund you any monies you have paid.
5
Accommodations
5.1 The
villa provided is only for the number of persons indicated by the guest
on the booking form at the time of booking. A
£100/$155 charge per day will be made per additional person, if
we are not notified at least 14 days prior to travel of any change in
the original numbers when the booking was accepted. The persons named on
the booking form may only occupy the accommodation; any deviation
without permission could result in eviction from the property.
5.2
Sub-letting, sharing, or assigning is strictly prohibited.
5.3 The
villa will be available to guests after 4.00 pm
Florida time. Early arrival and late departure is strictly prohibited,
failure to comply will result in the charge of an additional day’s
rental and you will be asked to leave the villa immediately.
5.4 The
villa must be vacated by 10.00 am Florida time on the day of departure (see 5.3
above), unless otherwise arranged and agreed.
5.5 An
adult must accompany guests under the age of 21.
6
Use of Swimming Pool and Spa
6.1
Guests using the pool or its surrounding areas
do so at their own risk. Children are required to be supervised
at all times when using the pool or on the pool deck area.
6.2 The
owners their servants or agents will accept no responsibility for any
loss or personal injury incurred from using the pool or its surrounding
areas.
6.3 No
bubble bath or similar liquids are to be used in the pool and spa. You
are required to shower or bath before you use the spa, especially if you
have sun oil/lotion or sand on your body. Please turn off spa jets and
cover spa after each use to conserve energy and reduce dust. If you
purchased pool heat, please cover the pool at night during winter months
to ensure a comfortable temperature for your use.

6.4 For
your own safety, glass or bottles are not allowed in the pool or spa.
6.5 You
will be liable for the full cost of any damage (including loss of rental
income while any damage is repaired) if you do not adhere to the
swimming pool and spa terms and conditions.
6.6 The
pool is cleaned and chemically balanced every week for your safety and
comfort; however on rare occasions it may be necessary to apply extra
chemicals to the pool to maintain safe and correct chemical levels.
Should this occur during your stay it will be necessary for you to be
out of the pool for a period of 12-24 hours for safety reasons.
7
Use of Utilities
7.1 Your
holiday home rental includes Accommodation as booked, including services
e.g. normal usage of gas, water, telephone and electricity (excludes
pool heating unless otherwise stated). NOT
included in our rental prices: a) Flights b)
Car Hire c) Holiday Insurance d) Pool Heating (unless
specified) e) 13% Florida Taxes, and credit card surcharges, if
necessary.
7.2 You
will be subject to the full costs of any additional charges if utility
bills for the period of your stay are in excess
of 10% above normal usage.
7.3 Cable
TV is provided and is included in the rental price.
8
Loss/damage/condition of home
8.1 Our
management company will advise us of any loss or damage to the villa
immediately following your departure. They will also provide a full
report on the general condition/cleanliness of the home.
8.2 We
will be fully reimbursed by the lead renter for any loss or damage
incurred during the duration of your stay as outlined in clause 1.9
above. We will also be fully reimbursed by the lead renter for any
additional cleaning costs as a result of their stay.
8.3 Any
loss, damage or cleaning fees costing in excess of the security deposit
amount will be fully reimbursed by the lead renter within one week (7
days) of departure.

Insects and pests
9.1
Insects and pests are inevitably present in the Florida climate. Within
reason, this is normal and we cannot take action to eradicate it.
9.2 The
villa receives periodic pest control treatment. Only when, in our
reasonable opinion, pests in the living accommodation are a serious
nuisance will further action is taken.
10
Complaints
10.1 We
sincerely hope you do not have any! ...But in the unlikely event that
you wish to register a complaint during your holiday, contact our
property management company (Iain Robinson at
USA 407 334 3804)
immediately, so that a speedy and remedial action is taken, and follow
this up with a letter. Give a copy to them and send us a copy on your
return. Unfortunately we are not always able to control the components
of your rented accommodation and it is possible that an advertised
facility may be withdrawn or changed due to circumstances beyond our
control and for which we cannot accept liability. The guest is to allow
the owner, and/or their agents the right to enter the property to carry
out any maintenance.
10.2 If
the management company for any reasons deemed 'unjustified/unwarranted',
a £50/$78 charge per call out will be
payable in advance.
11
Passports and travel documents
11.1
Passports and visas are your personal responsibility.
11.2 We
make no representations and provide no advice, orally, in writing, or
otherwise in relation to your passport or visa requirements to enter
into and remain in the USA.
11.3 You
should confirm all passport and visa requirements with the American
Embassy before booking the villa.

Animals and Pets
13.1
Although we personally love animals, for the health and safety of all
our guests, animals and pets are not permitted at the
Windsor Palms Resort.
14
Force Majeure and Liability Limitation
14.1
Force Majeure-The owners of the property, their servants or agents,
accept no liability to pay compensation. In respect of any loss, damage
or changes arising from unforeseeable circumstances beyond their
control, (but not limited to) strikes, riots, political unrest, war or
the threat of war, terrorist activities, industrial disputes, fire,
flood, technical/weather problems to transport, aircraft, closure of
airports, adverse weather conditions, or other events beyond our
control.
14.2
Liability-You are advised that you are occupying a private villa and
therefore are responsible for your own safety in respect of any loss,
personal accidents or damages sustained by you or any members of your
party during your stay. It is the guest’s responsibility to ensure that
they have adequate holiday insurance to cover personal injury/ accidents
/damage. No claims whatsoever will be accepted by the owners or there
agents of the property. The owner or their agents accept no liability
for loss of mains services or failure of appliances or of any actions
taken in the vicinity of the property by any authority or third party
persons bond their control.
14.3 In
the event that weather conditions fall above fifty (50) degrees
centigrade, the pool heating will automatically shut off to prevent
damage. No refund will be given in this event.
14.4 In
the unlikely event of us being negligent and/or in breach of our
contract with you, our liability shall be limited to the cost of your
booking with us.
14.5 We
accept no responsibility in respect of any loss or damage for which you
are, or should be insured or entitled to indemnity from any third party.
15 Accuracy of information
15.1 A
great deal of care has been taken to ensure the accuracy of information
we have provided. However, facilities and/or services may not be open or
available due to renovation/maintenance works, adverse weather, or
damage by a previous guest, that we have not had time to remedy before
your arrival; this may include the use of the computer and access to the
internet, TV’s, spa, etc. Where we are aware that a facility or service
advertised in the information provided will not be available during the
period of your stay, we will take steps, wherever possible, to notify
you prior to travel. From time to time, some furniture or amenities
(hair dryers, games, kitchen utensils, etc) might not be in the villa,
due to loss from previous guests. We trust all of our guests to be good
stewards of our home. Please notify us of any missing items, and we will
attempt to rectify the situation during your stay. However, no refund in
part or whole will be provided in any of the above-mentioned
circumstances.
15.2 We
reserve the right to reasonably amend any of the terms and conditions
set out herewith.
16 Travel
16.1 All
transportation by air, land or sea is subject to the terms and
conditions of the company providing the transport and not us.
17
Use of the Computer
17.1
Computer settings must not be changed at any time.
17.2 The
computer must not be used to access adult (i.e. pornographic) web sites.
17.3
Children must be supervised at all times when using the computer.
17.4
Failure to comply to the terms and conditions set out in 17.1, 17.2 and
17.3 will result in full loss of security deposit and loss of any rental
income whilst repairs are being effected to remedy any damage.
18 Governing law
18.1 The
laws of the United States of America shall apply to this contract and
any other claims.

20 Miscellaneous
20.1
Guest acknowledges that our vacation rental home is a self-catering
establishment. Although our cleaning crew does an exceptional job for
us, we are not a hotel. Occasional dust under the couch or cushions or
on the ceiling fans, etc. is typically cleaned twice a year during a
“Spring Clean”, and not a cause for refunds.
20.2 All
equipment within the villa, be it electrical or mechanical, is used
entirely at the lead renter’s own risk on behalf of themselves and their
party
20.3
WE STRONGLY ADVISE ALL OUR GUESTS TO TAKE OUT
TRAVEL INSURANCE FOR YOUR WHOLE PARTY, WHICH INCLUDES CANCELLATION
CHARGES COVERAGE (UK GUESTS ARE ALSO ADVISED TO TAKE OUT A POLICY WHICH
INCLUDES MEDICAL COVERAGE), AS SOON AS YOU HAVE BOOKED ANY PART OF YOUR
HOLIDAY OR VACATION. IF YOU CHOOSE NOT TO DO THIS, YOU NEED TO BE AWARE
THAT YOU WILL PERSONALLY BE RESPONSIBLE FOR PAYMENT OF ANY CANCELLATION
CHARGES WHICH MAY BECOME DUE.
